1. Agreement to Terms
By using the services, websites, and applications (collectively, the "Service") provided by To DO BIG ("we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
2. Our Service
We provide a subscription-based service for a human-augmented AI team. Our AI agents, managed by a human Project Manager, perform tasks related to strategy, research, design, and engineering based on the project brief you provide.
3. Payments, Subscriptions, and Pausing
Payments
You agree to pay all fees for the plan you select (e.g., "Starter," "Growth," "Scale"). All plans are billed in advance on a monthly basis and are non-refundable.
Pausing Your Subscription
You may pause your subscription at any time. If you pause, your subscription will remain active until the end of your current billing cycle, after which it will be paused, and you will not be billed again until you choose to resume. We will securely store your project files while your account is paused.
4. Intellectual Property
You own the work you create. All code, designs, content, and other assets ("Deliverables") that our Service creates specifically for you, based on your project brief, are your exclusive intellectual property. We claim no ownership rights to the Deliverables.
We retain ownership of our underlying AI agents, tools, and processes used to create the Deliverables. You retain ownership of the project briefs and any pre-existing materials you provide to us.
5. Acceptable Use
You agree not to use the Service to create any material that is unlawful, harmful, defamatory, or infringes on the intellectual property rights of a third party. We reserve the right to refuse or terminate service for any project we deem to be in violation of these terms.
6. Termination
You may cancel your subscription at any time. Your plan will remain active until the end of the current billing cycle. We may terminate or suspend your access to the Service at any time, without prior notice or liability, for any reason, including if you breach these Terms.
7. Disclaimer of Warranties
The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranty that the Service will be uninterrupted, error-free, or that the results will meet your exact requirements. Our human-in-the-loop process is designed to ensure the highest quality, but we cannot guarantee perfection.
8. Limitation of Liability
To the maximum extent permitted by law, To DO BIG shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, resulting from your use of the Service.
9. Changes to These Terms
We may modify these Terms at any time. We will notify you of any material changes by posting the new Terms on this page and updating the "Last Updated" date. Your continued use of the Service after any modification constitutes your acceptance of the new Terms.
